In consideration of acceptance of entry in the 22nd Annual West Yellowstone-Old Faithful Cycle Tour to be held Saturday, October 5, 2019, I acknowledge and agree to be bound by the following:
IDENTIFICATION OF RISKS: I understand that participation of any cycling activity involves risk of serious injury, including permanent disability, death or losses, both to inaction or negligence of others.
ASSUMPTION OF RISK: I agree that I am responsible for my safety while participating in the Activity and that such responsibility includes participation in the activity only: a) when I am both physically and psychologically prepared to participate safely, b) after fully familiarizing myself with the venue before beginning the activity and c) while using the equipment of a type and a condition reasonably necessary to safely participate in the activity. I assume all risk connected with responsibility for any injury or loss connected with my participation in the activity.
WAIVER: Aware of the risks and willing to assume them, I hereby waive, release and agree to hold harmless the West Yellowstone Chamber of Commerce and any of this organization’s affiliates, officers, directors, employees, agents, official event organizers, volunteers, or sponsors (“Released Parties”) from any and all claims by me for any liability, injury, loss or damage in any way connected with my participation in the activity, except where caused by gross negligence or willful or wanton misconduct of any of the Released Parties. I intend for my beneficiaries, next of kin, or assigns who might pursue any legal action of claim on my behalf.
APPLICABLE LAW: This waiver and release is formed under and to be interpreted under the laws of the State of Montana.
INSURANCE: I currently have and agree to maintain throughout the time that I train and complete, valid and sufficient medical and accident insurance. I understand that this is my sole responsibility and release all persons and entities from providing this coverage for me.
I HAVE READ THIS WAIVER AND RELEASE CAREFULLY AND HAVING DONE SO I AM SIGNING VOLUNTARILY
I understand there are no refunds, partial or otherwise, due to any reason including, but not limited to injury, illness, travel issues, financial hardship, or poor planning. I understand I am not able to transfer my registration to another year. I am able to sell or gift my registration to another person, provided the Cycle Tour Director is contacted and all the appropriate registration and waiver information is satisfactorily completed prior to the event.
We always hope for great weather during the WEST YELLOWSTONE OLD FAITHFUL CYCLE TOUR. The following details the steps and decisions we will make regarding the event if we face severe weather.
The WEST YELLOWSTONE OLD FAITHFUL CYCLE TOUR is a “rain or shine” event. Cyclists should prepare to ride in the rain, if the forecast calls for it. This means bringing along rain gear (including a bright colored jacket, vest or shirt). We will keep all riders up to date on the weather forecast, should a chance of storms be predicted. If it is raining, beware of wet roads.
If a rider hears thunder or sees lightning, they should make every effort to get themselves to a safe place immediately. If you are near a checkpoint, either stay or return to the closest one. Sag wagons will stop at each checkpoint and will make sure everyone is accounted for on the road.
The WEST YELLOWSTONE OLD FAITHFUL CYCLE TOUR may be delayed, altered, shortened, or end early due to inclement weather, i.e. early season snowfall that cannot be removed from the roadways in the Park. The ONLY way the event will be cancelled is in the event of severe storms, severe lightning, tornado threats or other extreme weather conditions. The West Yellowstone Old Faithful Cycle Tour event management will make these decisions as current and potential weather conditions become known and are studied.
Because a significant amount of the funds collected during registration have already been expended by the day of the event for the production of the event, and because each event is uniquely scheduled for its date and location, registration refunds are not possible and rescheduling the event is not feasible, and therefore we have a no refund policy.
West Yellowstone Old Faithful Cycle Tour will do everything we can to put on this event in a safe manner. In the event that biking is not possible, participants will still receive their gear bag, and be able to participate in our post-ride meal.

WAIVER: I, the undersigned participant (and my parent or guardian if I am younger than 18 years of age), intending to be legally bound, do hereby forever release and waive any and all rights, claims, and actions for damages that we, our heirs, executors, administrators, and assigns may have, or that may hereafter accrue against any and all persons, organizations, and other entities associated with the event, including, but not limited to Race Entry, USA Track and Field, sponsors, affiliates, volunteers, West Yellowstone Old Faithful Cycle Tour, and individual West Yellowstone Old Faithful Cycle Tour organizers, arising out of or in connection with my involvement before, during, or after the event.
I verify that I am physically fit and sufficiently trained to participate in this event and I assume the risks involved in this activity. I further attest that I will be mindful of traffic along the race course, and hold said sponsors and organizers blameless in any harm that may happen.
I also acknowledge understanding that the charge to my card will show up as Race Entry. I acknowledge that the online processing fees and charitable donations are non-refundable. I also acknowledge that any charitable donations will have 4.97% withheld from the donation to pay credit card and administrative costs.
Race Entry shall not be liable to you for any direct, indirect, special, incidental, consequential or exemplary damages including, but not limited to, loss of profits, goodwill, use, data or other intangible loses. Race Entry does not guarantee the completeness or accuracy of any information contained in, or provided in conjunction with the http://www.raceentry.com website. Race Entry is not responsible for any omissions or inaccuracies, or for the results obtained from this information.
Race Entry facilitates registration for various events, some of which allow participants under the age of thirteen (13). We require a submission of birth date for all registration entries. For children under the age of thirteen (13), parental or guardian consent is required.
You agree that the statutes and laws of the State of Utah, USA, will apply to all matters relating to this Agreement and Waiver. You irrevocably consent that exclusive jurisdiction for any dispute with Race Entry relating to this Agreement and Waiver resides in the courts of Utah, and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of Utah in conjunction with any such dispute including any claim involving Race Entry .
