In consideration of American Fork City accepting the registered participantâ€™s Steel Days Race (hereinafter the â€œRaceâ€) entry (10K, 5K, Kid Run or Tot Trot), the registered participant and his/her legal guardian if the registered participant is under the age of 18 (collectively referred to as â€œParticipantâ€) agree to the following: (1) Participant is aware that running/walking in the Race may be a hazardous activity; (2) Participant assumes all risks associated with running/walking in the Race, including, but not limited to, falls, contact with others, the effects of weather, and traffic and road conditions; (3) Participant hereby promises that the state of the registered participants physical health is sufficiently sound to permit him/her to safely participate in the Race; (4) Participant is not aware of any health related reasons or problems that would preclude or restrict the registered participants ability to take part in the Race; (5) Participant permits the free use of the registered participants name and/or pictures in telecasts, broadcasts, newspapers, posters, advertising, etc.; and (6) Participant consents to the registered participant receiving any medical attention which may be deemed advisable in the event of an injury, accident, and/or illness during participation in the Race. Participant understands that all medical costs for the registered participant will be borne by Participant.
Participant hereby releases, waives, discharges and covenants not to sue American Fork City, Runtastic Events, LeaseCo, Carol Bell, Herrington Center for the Arts, its board and officers, agents, affiliates, employees and volunteers from all liability, claims, demands, actions or causes of action whatsoever arising out of or related to loss, damage, or injury (including death) which may result from participation in the Race.
Participant hereby acknowledges and agrees to indemnify, save, and hold harmless American Fork City, Runtastic Events, LeaseCo, Carol Bell, Harrington Center for the Arts, its board and officers, agents, affiliates, employees and volunteers from any loss, liability, damage, or cost they may incur due to the registered participant competing, officiating, observing, or working for or for any purpose participating in the Race.
PARTICIPANT HAS READ AND UNDERSTANDS THIS RELEASE AND COVENANT NOT TO SUE IN ITS ENTIRETY.
By checking I Agree to Steel Days Waiver on the entry form, Participant accepts the Waiver and Release of Liability knowingly, voluntarily and without reliance on any representations, statements or inducements, express or implied, made by any party whomsoever.
No refunds allowed.There are transfer/deferral options for a fee. Deferrals/transfers must be done at least 3 days before the race
WAIVER: I, the undersigned participant (and my parent or guardian if I am younger than 18 years of age), intending to be legally bound, do hereby forever release and waive any and all rights, claims, and actions for damages that we, our heirs, executors, administrators, and assigns may have, or that may hereafter accrue against any and all persons, organizations, and other entities associated with the event, including, but not limited to Race Entry, USA Track and Field, sponsors, affiliates, volunteers, Steel Days 10K & 5K, and individual Steel Days 10K & 5K organizers, arising out of or in connection with my involvement before, during, or after the event.
I verify that I am physically fit and sufficiently trained to participate in this event and I assume the risks involved in this activity. I further attest that I will be mindful of traffic along the race course, and hold said sponsors and organizers blameless in any harm that may happen.
I also acknowledge understanding that the charge to my card will show up as Race Entry. I acknowledge that the online processing fees and charitable donations are non-refundable. I also acknowledge that any charitable donations will have 4.97% withheld from the donation to pay credit card and administrative costs.
Race Entry shall not be liable to you for any direct, indirect, special, incidental, consequential or exemplary damages including, but not limited to, loss of profits, goodwill, use, data or other intangible loses. Race Entry does not guarantee the completeness or accuracy of any information contained in, or provided in conjunction with the http://www.raceentry.com website. Race Entry is not responsible for any omissions or inaccuracies, or for the results obtained from this information.
Race Entry facilitates registration for various events, some of which allow participants under the age of thirteen (13). We require a submission of birth date for all registration entries. For children under the age of thirteen (13), parental or guardian consent is required.
You agree that the statutes and laws of the State of Utah, USA, will apply to all matters relating to this Agreement and Waiver. You irrevocably consent that exclusive jurisdiction for any dispute with Race Entry relating to this Agreement and Waiver resides in the courts of Utah, and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of Utah in conjunction with any such dispute including any claim involving Race Entry .
