Faithful 5K Participant Waiver and Release of Liability

This Participant Waiver and Release of Liability applies to all individuals registering for, attending, accompanying others, or participating in the Faithful 5K, whether in person or virtually.

By registering for or participating in the Faithful 5K, I acknowledge and agree to the following:

1. Assumption of Risk

I understand that participating in a 5K walk/run involves physical activity and carries inherent risks, including but not limited to muscle strain, falls, contact with other participants, uneven surfaces, traffic hazards, weather conditions, heat, dehydration, illness, injury, or, in rare cases, serious injury or death.

I acknowledge that I am voluntarily participating in this event and assume full responsibility for any risks, injuries, damages, or losses that may occur as a result of my participation.

2. Health and Fitness Acknowledgment

I certify that I am physically able to participate in this event and have not been advised by a qualified medical professional to avoid physical activity.

I understand that it is my responsibility to consult with a physician before participating if I have any medical concerns, health conditions, or uncertainty about my ability to safely complete a 5K.

I agree to participate at my own pace and to stop immediately if I experience pain, dizziness, shortness of breath, chest discomfort, or any other concerning symptoms.

3. Virtual Participation

For virtual participants, I understand that Faithful Fitness, Train Hard Pray Harder LLC, Coach Alex VanHouten, event organizers, volunteers, sponsors, partners, affiliates, and associated parties do not supervise, select, inspect, or control my chosen route, environment, weather conditions, traffic conditions, or personal safety precautions.

I am solely responsible for choosing a safe location, obeying all traffic laws, remaining aware of my surroundings, and participating in a manner that is safe and appropriate for my fitness level.

4. Minors, Children, and Parental/Guardian Responsibility

Participants under 18 years of age may only participate in the Faithful 5K with the full knowledge, consent, and approval of a parent or legal guardian.

By registering a minor, allowing a minor to participate, or bringing a minor to the event, the parent or legal guardian agrees to this waiver on behalf of the minor and accepts full responsibility for the minor’s participation, supervision, safety, conduct, and well-being.

Parents and legal guardians acknowledge that minors may be exposed to the same risks as adult participants, including but not limited to physical exertion, falls, weather conditions, crowds, traffic, uneven surfaces, illness, injury, or other foreseeable and unforeseeable risks.

The parent or legal guardian assumes full liability and responsibility for any injury, illness, damage, loss, or claim involving the minor arising out of or related to the minor’s attendance, participation, accompaniment, or presence at the event.

The Faithful 5K does not provide childcare, child supervision, or individual monitoring of minors. All children attending or participating in the event remain the responsibility of their parent, legal guardian, or supervising adult at all times.

Children 9 years of age and under must remain within arm’s reach of a parent, legal guardian, or supervising adult at all times during the event, including before, during, and after the race.

Children under 18 may not be dropped off or left unattended at the event.

5. Release of Liability

In consideration of being permitted to participate in or attend the Faithful 5K, I, on behalf of myself, my heirs, executors, administrators, assigns, personal representatives, and, where applicable, any minor child under my care, hereby release, waive, discharge, and hold harmless:

Faithful Fitness | Train Hard Pray Harder LLC, Coach Alex VanHouten, THREE18, event organizers, volunteers, sponsors, vendors, affiliates, partners, the City of Greenbrier, Matthews Park, property owners, law enforcement, traffic personnel, and any associated individuals or organizations

from any and all claims, liabilities, demands, actions, causes of action, damages, costs, or expenses arising out of or related to my participation, attendance, or involvement in the event.

This release includes, but is not limited to, claims related to personal injury, illness, death, property damage, theft, loss, or ordinary negligence, to the fullest extent permitted by law.

6. Medical Treatment

I authorize event organizers, volunteers, or emergency personnel to seek medical treatment on my behalf or on behalf of any minor child under my care if I or the minor become injured or ill during the event and am unable to make decisions at that time.

I understand that I am responsible for any medical expenses incurred as a result of my participation or the participation/attendance of any minor child under my care.

7. Event Rules and Safety

I agree to follow all event rules, safety instructions, route directions, traffic guidance, venue requirements, and instructions provided by event organizers, volunteers, law enforcement, or traffic personnel.

I understand that the Event Organizer reserves the right to remove any participant, spectator, parent/guardian, or minor from the event for unsafe, disruptive, inappropriate, or noncompliant behavior.

8. Photo and Media Release

I grant Faithful Fitness | Train Hard Pray Harder LLC and its representatives permission to use photographs, videos, audio recordings, testimonials, social media posts, race results, or other media that may include my name, image, likeness, voice, or participation in the event for promotional, educational, social media, website, marketing, or other business purposes without compensation.

For minors, the parent or legal guardian grants this permission on behalf of the minor participant or attending child.

For virtual participants, this includes any photos, videos, posts, or race results voluntarily submitted, tagged, or shared in connection with the event.

9. Agreement

I have read this waiver and release of liability, understand its terms, and understand that I am giving up certain legal rights by agreeing to it.

I agree voluntarily and intend my registration, signature, or participation to serve as my acceptance of this waiver.
