Participant Assumption of Risk, Waiver of Liability, Release, and Indemnification Agreement

By signing this Agreement, I acknowledge that I am voluntarily participating in Zombie Dash ("Event") and fully understand the nature of the activities involved.

1. Assumption of Risk

I understand that Zombie Dash is an interactive Halloween-themed obstacle running event involving physical activity, uneven terrain, obstacles, theatrical effects, and volunteer or paid actors portraying zombies.

I understand that during the Event I may encounter:

• Individuals dressed as zombies.
• Actors intentionally attempting to scare participants.
• Actors chasing participants.
• Actors attempting to remove participant "survivor flags."
• Loud noises.
• Fog effects.
• Flashing lights.
• Darkness or low-light environments.
• Uneven terrain.
• Mud, dirt, rocks, grass, pavement, and other natural or artificial surfaces.
• Physical obstacles requiring climbing, crawling, balancing, jumping, or maneuvering.

I understand these activities involve inherent risks including, but not limited to:

• Falls
• Slips
• Trips
• Sprains
• Broken bones
• Cuts and abrasions
• Bruises
• Emotional distress
• Fright or surprise
• Contact with other participants
• Contact with event staff or zombie actors

I knowingly and voluntarily assume all risks associated with participating.

2. Zombie Interaction

I acknowledge that zombie actors are a central feature of this Event.

I understand and voluntarily accept that zombie actors may:

• Chase me.
• Reach toward me.
• Attempt to remove my participant flags.
• Make brief physical contact necessary to remove a flag.
• Touch my shoulders, upper back, arms, waist, or flag belt while attempting to remove a flag.

I understand this contact is intentional and is part of the Event experience.

I voluntarily consent to such contact.

3. Flag Placement

Participant flags must be worn on the provided belt at the participant's sides or rear.

Participants shall not:

• Hold flags in their hands.
• Place flags in front of their body.
• Shield flags with their hands or arms.
• Physically resist a zombie actor attempting to remove a flag.

Participants understand that improper flag placement may result in disqualification.

4. Participant Conduct

I agree that I will not:

• Strike, shove, kick, punch, or otherwise make aggressive contact with zombie actors.
• Grab zombie actors.
• Intentionally collide with staff or volunteers.
• Use abusive or threatening language.
• Consume illegal drugs before or during the Event.
• Participate while impaired by alcohol or drugs.

Failure to comply may result in immediate removal without refund.

5. Medical Condition

I certify that I am physically capable of participating.

I understand participation may require running, climbing, crawling, lifting my own body weight, and navigating obstacles.

I accept full responsibility for determining my own fitness.

6. Release of Liability

To the fullest extent permitted by law, I release and forever discharge:

• Wasatch Events LLC
• Zombie Dash
• Event organizers
• Sponsors
• Volunteers
• Zombie actors
• Employees
• Contractors
• Venue owners
• Government agencies
• Property owners

from any and all claims, demands, damages, causes of action, liabilities, expenses, attorney fees, or lawsuits arising out of or related to my participation in the Event, including claims arising from ordinary negligence.

This release includes claims involving:

• Physical contact by zombie actors while removing participant flags
• Scares or theatrical performances
• Obstacles
• Falls
• Collisions
• Weather
• Participant negligence
• Volunteer negligence

This release does not apply to claims arising from gross negligence, reckless conduct, or intentional misconduct where such releases are prohibited by applicable law.

7. Medical Treatment

If injured, I authorize Event personnel to obtain emergency medical treatment if deemed necessary.

I accept full financial responsibility for any medical expenses incurred.

8. Photography & Video

I grant Zombie Dash and Wasatch Events LLC permission to photograph, videotape, livestream, and otherwise record me during the Event.

I grant an irrevocable, royalty-free license to use my image for advertising, promotional, and marketing purposes without compensation.

9. Refund Policy

I understand that registration fees are non-refundable except as required by law or as expressly stated in the Event's published policies.

10. Indemnification

I agree to defend, indemnify, and hold harmless Wasatch Events LLC, Zombie Dash, the venue, sponsors, volunteers, contractors, and all released parties from any claims, damages, liabilities, or expenses arising from my actions or violations of this Agreement.
