ELECTRONIC PARTICIPANT WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND PHOTO RELEASE

PLEASE READ CAREFULLY. BY SELECTING "I AGREE" AND COMPLETING REGISTRATION, YOU ARE AGREEING TO THE TERMS OF THIS WAIVER.

In consideration of being permitted to participate in the Pink Springs Stronger Together Pink Out 5K, including any associated walks, runs, Kids Dash events, activities, and programs (collectively, the "Event"), I acknowledge and agree to the following:

ASSUMPTION OF RISK

I understand that participation in the Event involves inherent risks, including but not limited to falls, contact with other participants, spectators, vehicles, road conditions, weather conditions, dehydration, illness, equipment failure, and other hazards that may result in injury, illness, property damage, permanent disability, or death.

I voluntarily assume all risks associated with participation in the Event, whether known or unknown.

HEALTH CERTIFICATION

I certify that I am physically capable of participating in the Event and have not been advised otherwise by a qualified medical professional. I understand that it is my responsibility to determine whether I am sufficiently fit and healthy to participate.

RELEASE OF LIABILITY

To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless Pink Springs, its officers, directors, board members, volunteers, sponsors, vendors, contractors, event partners, property owners, the City of Fort Stockton, Pecos County, law enforcement agencies, emergency medical personnel, and all other Event affiliates and representatives (collectively, the "Released Parties") from any and all claims, liabilities, demands, damages, costs, expenses, actions, or causes of action arising out of or related to my participation in the Event, including those resulting from the ordinary negligence of the Released Parties.

EMERGENCY MEDICAL TREATMENT

I authorize Event personnel to obtain emergency medical treatment for me if deemed necessary during the Event. I understand that I am responsible for any medical expenses incurred as a result of such treatment.

RULES AND EVENT CONDUCT

I agree to follow all Event rules and instructions provided by Event staff, volunteers, law enforcement officers, and emergency personnel. I understand that failure to do so may result in my removal from the Event without refund.

PHOTO, VIDEO, AND MEDIA RELEASE

I grant Pink Springs and its representatives permission to photograph, videotape, record, and otherwise capture my image, likeness, voice, and participation in the Event. I understand that these materials may be used in print, digital, social media, advertising, educational, fundraising, and promotional materials without compensation or further permission.

REGISTRATION FEES

I understand that registration fees and donations are non-refundable and non-transferable except as determined by Event organizers.

MINOR PARTICIPANTS

If I am registering a participant under the age of 18, I certify that I am the parent or legal guardian of the minor participant and have the legal authority to agree to this waiver on the minor's behalf. I agree to all terms of this waiver for both me and the minor participant and accept responsibility for the minor's participation.

ELECTRONIC CONSENT

By selecting "I Agree," submitting this registration, and/or participating in the Event, I acknowledge that:

• I have carefully read and fully understand this waiver and release.
• I understand that I am giving up certain legal rights by agreeing to these terms.
• I voluntarily accept all terms and conditions contained herein.
• My electronic acceptance shall have the same force and effect as my handwritten signature.
