1. ACKNOWLEDGMENT AND ASSUMPTION OF RISK
I am the parent or legal guardian of the minor participant identified above (“Participant”), and I voluntarily give permission for the Participant to participate in the Saint Michael’s College Nordic Ski Team Youth Triathlon and related activities (“Event”).
I understand that participation in a triathlon and related athletic activities involves inherent and other risks of injury, illness, property damage, disability, and, in rare circumstances, death. Risks may include, but are not limited to:
- Running, bicycling, swimming, skiing, or other activities included in the Event;
- Falls, collisions, crashes, slips, trips, and contact with other participants, spectators, vehicles, bicycles, equipment, structures, or natural objects;
- Uneven, wet, slippery, icy, paved, unpaved, or otherwise hazardous surfaces;
- Weather conditions, including heat, cold, rain, wind, and sun exposure;
- Physical exertion, dehydration, exhaustion, allergic reactions, or other medical events;
- Equipment failure or misuse;
- Actions or omissions of the Participant, other participants, volunteers, spectators, or third parties; and
- Other foreseeable or unforeseeable risks associated with participation in an athletic event.
I knowingly and voluntarily accept and assume these risks on behalf of myself and the Participant.
2. RELEASE AND WAIVER OF LIABILITY
To the fullest extent permitted by applicable law, I, individually and on behalf of the Participant, our heirs, representatives, executors, administrators, and assigns, hereby release, waive, and discharge Saint Michael’s College and its trustees, officers, employees, agents, representatives, coaches, Nordic ski team members, student volunteers, event organizers, volunteers, sponsors, and affiliated persons or organizations (collectively, the “Released Parties”) from claims, demands, causes of action, damages, losses, costs, or liabilities arising out of or relating to the Participant’s participation in the Event, including claims arising from the ordinary negligence of a Released Party, to the extent such claims may lawfully be released under Vermont law.
This release is intended to apply to personal injury, illness, death, and loss of or damage to personal property associated with participation in or attendance at the Event.
Nothing in this Agreement is intended to release or waive liability that cannot lawfully be released or waived under applicable law.
3. PARENT/GUARDIAN RESPONSIBILITY AND INDEMNIFICATION
To the fullest extent permitted by law, I agree to be responsible for the Participant’s conduct and compliance with Event rules and instructions.
I further agree to indemnify and hold harmless the Released Parties from claims, damages, losses, or expenses arising from the Participant’s acts or conduct in connection with the Event, except to the extent such indemnification is prohibited by applicable law or arises from liability that cannot legally be waived or transferred.
I understand that I remain responsible for medical expenses and other costs incurred on behalf of the Participant that are not otherwise paid by applicable insurance, subject to applicable law.
4. PARTICIPANT HEALTH AND FITNESS
I represent that, to the best of my knowledge, the Participant is physically capable of safely participating in the Event.
I understand that it is my responsibility to disclose any relevant medical condition, allergy, medication, physical limitation, or other circumstance that Event personnel should reasonably know in order to respond appropriately in an emergency.
5. MEDICAL AUTHORIZATION
In the event of an injury, illness, or medical emergency, I authorize Event personnel and the Released Parties to provide or obtain reasonable first aid and emergency medical assistance for the Participant.
If I cannot be reached promptly, I authorize emergency medical personnel to evaluate and treat the Participant as reasonably necessary.
I understand that Saint Michael’s College and Event personnel do not guarantee the availability or outcome of medical treatment. To the extent permitted by law, I accept financial responsibility for medical treatment provided to the Participant that is not otherwise covered by insurance.
6. EVENT RULES AND SAFETY
I agree that the Participant will follow reasonable Event rules, course markings, safety requirements, and instructions from Event officials and volunteers.
I understand that Event personnel may stop or remove the Participant from an activity if they reasonably believe continued participation presents a safety concern or if the Participant fails to follow Event rules.
I will ensure that the Participant uses any required safety equipment appropriate for the Event.
7. PERSONAL PROPERTY
I understand that the Participant and I are responsible for personal belongings and equipment brought to the Event. To the fullest extent permitted by law, the Released Parties are not responsible for lost, stolen, or damaged personal property.
8. SEVERABILITY AND GOVERNING LAW
This Agreement is intended to be as broad as permitted by applicable law. If any provision is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
This Agreement shall be governed by the laws of the State of Vermont, without regard to conflict-of-law principles.
9. PARENT/GUARDIAN ACKNOWLEDGMENT
I CERTIFY THAT I AM THE PARTICIPANT’S PARENT OR LEGAL GUARDIAN AND HAVE AUTHORITY TO SIGN THIS AGREEMENT ON THE PARTICIPANT’S BEHALF.
I HAVE READ THIS ENTIRE AGREEMENT AND UNDERSTAND THAT IT CONTAINS AN ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND INDEMNIFICATION PROVISIONS THAT MAY AFFECT LEGAL RIGHTS.
I UNDERSTAND THE RISKS ASSOCIATED WITH THE PARTICIPANT’S PARTICIPATION AND VOLUNTARILY CONSENT TO THE PARTICIPANT TAKING PART IN THE EVENT.
