I agree to the following:
In consideration of my participation in any event (“Event”) sponsored or hosted by SLS Community, to include “running clubs” and the SLS Dash 5K for Neurodiversity, I, the undersigned, (and my legal parent or guardian if under 18 years of age or otherwise applicable) for myself, my heirs, executors, administrators, successors and assigns, hereby release, waive and forever discharge, SLS Community, all event officers, directors, agents, employees, volunteers, independent contractors, members, clubs, officials, event directors, local associations, sponsors and affiliates as well as sponsors, organizers, property owners, law enforcement agencies, local governments, and other public entities, connected with an Event, and each of their respective officers, agents, employees, and volunteers (collectively, “Releasees”) from any claims that may arise out of or are related to my participation in an Event, including claims arising from the ordinary negligence of Releasees, whether prior to, during or subsequent to the event.
I will not make any claim against Releasees for injury, damage, death, or any other loss arising from or related to my participation in the Event. I understand that if I attempt to sue Releasees in violation of this agreement, Releasees may seek to recover all of their costs, including legal fees. I agree to indemnify, hold harmless, and defend Releasees from and against any actions, causes of action, claims, charges, demands, losses, damages, costs, attorney’s fees, judgments, liens, indebtedness, and liabilities of every kind, whether known or unknown, including foreseen or unforeseen bodily injury and personal injuries and property damage that may be sustained by me or any other person in any way connected to, related to, or arising out of my participation in the Event.
I am aware that exercise during an Event involves inherent risks, including but not limited to collision with pedestrians, vehicles, other participants, animals, and fixed or moving objects; imperfect course conditions; surface hazards, including potholes; equipment failure; inadequate safety equipment; use of equipment or materials provided to me by others; those associated with man-made and natural jumps; sickness or disease (including communicable disease); and weather conditions. I fully understand that participating in an Event is a test of a person’s physical and mental limits and may involve the risk of serious injury or death, economic loss, property damage or loss that may result from my actions, inactions or negligence, and also from the actions, inactions or negligence of others.
I assume all risks and accept sole responsibility for any injury (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with attending or volunteering for an event sponsored or hosted by SLS Community.
Specifically relating to the global COVID-19 pandemic, I acknowledge the highly contagious nature of COVID-19 and voluntarily assume the risk of exposure or infection by attending events, and that such exposure or infection may result in personal injury, illness, disability, and/or death. I understand that the risk of becoming exposed to or infected by COVID-19 at an SLS Community event may result from the actions, omissions, or negligence of others who may attend the event or their families, colleagues, or others with whom they may have contact. Accordingly, I understand and agree that this release includes any claims based on the actions, omissions, or negligence of SLS Community, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation as a volunteer in an SLS Community event.
In addition to all other rules and regulations relating to my voluntary participation at an SLS Community event, I agree to comply with all COVID-related procedures that may be implemented by SLS Community and the event venue, including, but not limited to, mask-wearing and social distancing requirements and restrictions on certain activities that carry higher COVID-related risk, in order to protect as much as possible the health and safety of all event attendees.
I hereby authorize first aid in case of emergency from attending medical personnel or emergency services. I understand that I am responsible for any charges incurred by me or on my behalf for medical treatment.
I represent that I am in good health and proper physical condition to participate in an Event safely. I acknowledge that it is my sole responsibility to make such determination and that I am responsible for my well-being at all times while participating in an Event. If I suffer any injury related to or arising from an Event, I consent to the release of my name and medical information by any third party to Releasees and their insurance carriers.
I approve the use of any photos or videos of myself taken at this event for use in promotional materials, social media, and advertising by SLS Community and host organizations. I irrevocably grant and license to SLS Community the right to capture and use my image, likeness, name, voice, comments or other proprietary or public rights in any broadcast, telecast, photograph, video, or audio sound recording taken in connection with an Event, without compensation, for all purposes, including any commercial use so long as such use does not imply my endorsement of any company, product or service.
I hereby further agree that my failure to sign the volunteer waiver will mean I will not be allowed to participate in the event.
I agree that the statutes and laws of the State of Arkansas, USA, will apply to all matters relating to this Agreement and Waiver. I irrevocably consent that exclusive jurisdiction for any dispute with SLS Community relating to this Agreement and Waiver resides in the courts of Arkansas, and I further agree and expressly consent to the exercise of personal jurisdiction in the courts of Arkansas in conjunction with any such dispute including any claim involving SLS Community.
I have carefully read the preceding and understand its terms. I know that I am giving up substantial rights, including my right to sue Releasees for injuries resulting from the inherent risks of exercise and the ordinary negligence of Releasees. I acknowledge that I am signing this agreement freely and voluntarily. I intend my signature to be a complete and unconditional release of all liability to the greatest extent permitted by law.
