MEDIA RELEASE AND LIABILITY WAIVER AGREEMENT
Participation. As consideration for the right to participate in Radical Races, LLC, I for myself, my heirs, executors, administrators, assigns, next of kind, or personal representative knowingly and voluntarily enter into this waiver and release of liability and hereby waive any and all rights, claims, or causes of action of any kind whatsoever arising out of my participation in Radical Races, LLC and do hereby release and forever Radical Races, LLC, its affiliates, managers, members, agents, attorneys, staff, representatives, and assigns for any physical or psychological injury, including but not limited to death, paralysis, illness, economical or emotional loss, that I may suffer as a direct result of my participation in Radical Races LLC Event.
Inherently hazardous. I am aware that participation in Radical Races, LLC is inherently hazardous and that I could be seriously injured or even killed. I am voluntarily participating in Radical Races, LLC Event with knowledge of the danger involved, and agree to assume any and all risks of bodily injury, death, or property damage, whether those risks are known or unknown.
Potential Injury or Death. I acknowledge that participation in Radical Races, LLC may carry with it the potential for death, serious injury, and property loss. The risks may include, but are not limited to death, paralysis, bruising, falling from heights up to 50 feet, falls, sprains, scrapes, muscle aches, cramps, and broken bones.
Release of Liability. I agree to indemnify and hold harmless against any and all claims, suits, or actions of any kind whatsoever for liability, damages, compensation, or otherwise brought by me, my next of kind, or anyone on my behalf, including attorney’s fees, and any related costs, if litigation arises pursuant to any claims made by me or anyone else acting on my behalf. If Radical Races, LLC incurs any of these types of expenses, I agree to reimburse.
Release of Entity. I acknowledge that Radical Races, LLC and its directors, officers, representatives, and agents are not responsible for errors, omissions, acts, or failures to act of any party or entity that participates in Radical Races, LLC specific event.
Contact with Others. I understand participation in this event may result in physical contact with other participants, volunteers, race personnel, contract service providers, employees, bystanders, and spectators; such contact may result in the potential contraction of a communicable disease including, but not limited to COVID-19. I further agree to abide by the Center for Disease Control’s (CDC) recommendations for the prevention of the spread of the 2019 Novel Coronavirus Disease (COVID-19) as directed on https://www.cdc.gov/coronavirus/2019-ncov/prepare/prevention.html. I assume all such risks being known, appreciated, and accepted by me.
Prohibited I understand that bicycles, skateboards, baby joggers/strollers, roller skates or inline skates, animals, and personal music players are not allowed in the race. I will abide by all race rules as listed on Radical Races, LLC website www.radicalraces.com.
Emergency Contact. In the event of an emergency, I give Radical Races, LLC permission to contact my designated emergency contact and disclose relevant medical information to that individual.
Media Release. I grant permission to Radical Races, LLC to use my likeness in photo or video form for purposes such as advertising, social media posts, website content, marketing collateral, and other legitimate business purposes.

WAIVER: I, the undersigned participant (and my parent or guardian if I am younger than 18 years of age), intending to be legally bound, do hereby forever release and waive any and all rights, claims, and actions for damages that we, our heirs, executors, administrators, and assigns may have, or that may hereafter accrue against any and all persons, organizations, and other entities associated with the event, including, but not limited to Race Entry, sponsors, affiliates, volunteers, Near Death Race, and individual Near Death Race organizers, arising out of or in connection with my involvement before, during, or after the event.
I verify that I am physically fit and sufficiently trained to participate in this event and I assume the risks involved in this activity. I further attest that I will be mindful of traffic along the race course, and hold said sponsors and organizers blameless in any harm that may happen.
I consent to the collection and use of my Personal Information as contained in the Privacy Policy. I also give my permission for the free use of my name and/or pictures in telecasts, broadcasts, newspapers, posters, advertising, etc.
I also acknowledge understanding that the charge to my card will show up as Race Entry. I acknowledge that the online processing fees and charitable donations are non-refundable. I also acknowledge that any charitable donations will have 4.97% withheld from the donation to pay credit card and administrative costs.
Race Entry shall not be liable to you for any direct, indirect, special, incidental, consequential or exemplary damages including, but not limited to, loss of profits, goodwill, use, data or other intangible loses. Race Entry does not guarantee the completeness or accuracy of any information contained in, or provided in conjunction with the http://www.raceentry.com website. Race Entry is not responsible for any omissions or inaccuracies, or for the results obtained from this information.
Race Entry facilitates registration for various events, some of which allow participants under the age of thirteen (13). We require a submission of birth date for all registration entries. For children under the age of thirteen (13), parental or guardian consent is required.
You agree that the statutes and laws of the State of Utah, USA, will apply to all matters relating to this Agreement and Waiver. You irrevocably consent that exclusive jurisdiction for any dispute with Race Entry relating to this Agreement and Waiver resides in the courts of Utah, and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of Utah in conjunction with any such dispute including any claim involving Race Entry .
