Read this waiver carefully. It includes a release of liability and waiver of legal rights and deprives you of the ability to sue certain parties. Do not agree to this document unless you have read and understood it in its entirety. By agreeing electronically or by signing, you acknowledge that you have both read and understood the text presented to you as part of the registration process. You also understand and agree that events carry certain inherent dangers and risks which may or may not be readily foreseeable, including without limitation personal injury, property damage or death. Your ability to participate in the event is subject to your agreement to the waiver and by agreeing herein, you accept and agree to the terms of the waiver and release agreement. I certify that I am physically fit, have sufficiently trained and prepared for participation in this event and have not been advised otherwise by a qualified medical person. I acknowledge that this athletic event is an extreme test of a person’s physical and mental limits and carries with it the potential for death, serious injury and property loss. The risks include, but are not limited to, those caused by terrain, facilities, temperature, weather, lighting conditions, condition of athletes, lack of hydration, equipment, vehicular traffic, actions of other people including, but not limited to, participants, volunteers, spectators, journalists, event officials, event monitors, and/or producers of the event. The risks are not only inherent to athletics but are also present for volunteers and support staff. I hereby assume all of the risks of participating and/or volunteering in this event called Iron Lung hosted by Michelle Lyman LLC and held on July 18, 2020. I know that bike riding and/or driving, regardless of the distance, is a potentially hazardous activity, and that I should not enter and participate unless I am medically able and properly trained. I agreed to abide by any decision of a race official relative to my ability to safely complete this road race and I further agree that race officials may authorize necessary emergency treatment for me. I also understand that police protection may not be provided, and both vehicle traffic and spectators may be present along the course. I assume the risk of riding and/or driving under such conditions, and I further assume any and all other risks associated with participating in the Iron Lung event including, but not limited to illness, traveling to and from the event, falls, contact with spectators or other participants, the effects of weather (including temperature extremes, humidity, dark or light conditions), and the surface conditions of the roads, all such risks being known and appreciated by me. As a condition of my participation, I further agree to abide by all traffic and pedestrian laws and regulations, and understand that my failure to do so may be grounds for disqualification from the event. In consideration of my application and permitting me to participate in this event, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, or anyone else whom might claim on my behalf, covenant not to sue, and waive, release and discharge the founder, Michelle Lyman, Iron Lung race officials, volunteers, and any and other sponsors, suppliers, agents, independent contracts, employees and other personnel in any way assisting or connected with this event from any and all claims and any and all liability for my death, disability, personal injury, property damage, property theft or actions of any kind which may hereafter accrue to me or my traveling to and from this event or any other liability of any kind or nature whatsoever arising out of my participation in this event, even though such liability may arise out of negligence or carelessness on the part of the persons or entities named in this waiver. Each of us individually (and/or as parent and/or guardian of the named minor) do hereby release, remise, waive and forever discharge the State of Utah, Weber County, Morgan County, Salt Lake County, Salt Lake City, This Is The Place Heritage Park, the Utah Department of Transportation, the Utah Transportation Commission, the Utah Highway Patrol, and their officers, agents, and employees of all the above mentioned entities from all liability, claims, demands, actions or causes of action whatsoever arising out of or related to loss or damages and/or injuries, including death, which may result from my participation in the Iron Lung event on July 18, 2020, involving roads within the Utah State Highway system. UDOT WAIVER AND RELEASE OF DAMAGES AGAINST THE STATE OF UTAH FOR PARTICIPATION IN AN APPROVED SPECIAL EVENT ON STATE ROADS - Each of us individually (and/or as parent and/or guardian of the named minor) do hereby release, remise, waive and forever discharge the State of Utah, the Utah Department of Transportation, the Utah Transportation Commission, the Utah Highway Patrol, and their officers, agents, and employees from all liability, claims, demands, actions or causes of action whatsoever arising out of or related to loss, or damages and/or injuries, including death, which may result from my participation in the Iron Lung bike event, involving roads within the Utah State Highway system. I hereby authorize Michelle Lyman LLC to use my image or likeness for race promotional purposes. I understand that race registration fees are nonrefundable. I certify that I have read this document and I understand its content.
WAIVER: I, the undersigned participant (and my parent or guardian if I am younger than 18 years of age), intending to be legally bound, do hereby forever release and waive any and all rights, claims, and actions for damages that we, our heirs, executors, administrators, and assigns may have, or that may hereafter accrue against any and all persons, organizations, and other entities associated with the event, including, but not limited to Race Entry, USA Track and Field, sponsors, affiliates, volunteers, Iron Lung, and individual Iron Lung organizers, arising out of or in connection with my involvement before, during, or after the event.
I verify that I am physically fit and sufficiently trained to participate in this event and I assume the risks involved in this activity. I further attest that I will be mindful of traffic along the race course, and hold said sponsors and organizers blameless in any harm that may happen.
I also acknowledge understanding that the charge to my card will show up as Race Entry. I acknowledge that the online processing fees and charitable donations are non-refundable. I also acknowledge that any charitable donations will have 4.97% withheld from the donation to pay credit card and administrative costs.
Race Entry shall not be liable to you for any direct, indirect, special, incidental, consequential or exemplary damages including, but not limited to, loss of profits, goodwill, use, data or other intangible loses. Race Entry does not guarantee the completeness or accuracy of any information contained in, or provided in conjunction with the http://www.raceentry.com website. Race Entry is not responsible for any omissions or inaccuracies, or for the results obtained from this information.
Race Entry facilitates registration for various events, some of which allow participants under the age of thirteen (13). We require a submission of birth date for all registration entries. For children under the age of thirteen (13), parental or guardian consent is required.
You agree that the statutes and laws of the State of Utah, USA, will apply to all matters relating to this Agreement and Waiver. You irrevocably consent that exclusive jurisdiction for any dispute with Race Entry relating to this Agreement and Waiver resides in the courts of Utah, and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of Utah in conjunction with any such dispute including any claim involving Race Entry .
