Hope Rises 5k Fundraiser Waiver
THIS HOPE RISES 5k FUNDRAISER WAIVER (this "Waiver") is dated the day that registration for the Hope Rises 5k Fundraiser, and acknowledgment of and agreement to this Waiver, was completed by the person registering for the Hopes Rises 5k Fundraiser or that person's legal guardian.
IN CONSIDERATION of being allowed to participate in the Hope Rises 5k Fundraiser (the “Activity”) and other good and valuable consideration, the receipt of which is hereby acknowledged, I, the person registering for the Activity (the "Participant"), and my parent or legal guardian if I am younger than 18 years of age, agree with Rachel Pool of 756 E 700 N, Provo, UT 84606, USA and Hintze Garrett of 95 S 280 E, Orem, UT 84058, USA (collectively the "Activity Provider") to the following:
DETAILS OF ACTIVITY
1. Scheduled for March 28, 2026, the Participant will be participating in the following activity: Hope Rises 5k fundraiser in Vineyard, UT (the "Activity") provided by the Activity Provider.
CONSIDERATION
2. Being of lawful age and in consideration of being permitted to participate in the Activity, the Participant, or the Participant's parent or legal guardian if the Participant is under 18 years of age, releases and forever discharges the Activity Provider, the Activity Provider's spouse, heirs, executors, administrators, legal representatives, and assigns from all manner of actions, causes of action, debts, accounts, bonds, contracts, claims, and demands for or by reason of any injury to person or property, including injury resulting in the death of the Participant, which has been or may be sustained as a consequence of the Participant's participation in the Activity, and notwithstanding that such damage, loss, or injury may have been caused solely or partly by any negligence of the Activity Provider.
3. The Participant, or the Participant's parent or legal guardian if the Participant is under 18 years of age, understands that the Participant would not be permitted to participate in the Activity unless the Participant, or the Participant's parent or legal guardian if the Participant is under 18 years of age, signed this Waiver.
CONCURRENT RELEASE
4. The Participant, or the Participant's parent or legal guardian if the Participant is under 18 years of age, acknowledges the risks and dangers inherent in this Activity and wishes to participate with full knowledge of the risks being undertaken. The Participant, or the Participant's parent or legal guardian if the Participant is under 18 years of age, acknowledges that this Waiver is given with the express intention of effecting the extinguishment of certain obligations owed to the Participant or their legal guardian(s) by the Activity Provider, and with the express intention of effecting the release of all liability of the Activity Provider as described without limitation in Paragraph 2 above, and with the express intention of binding the Participant's spouse, heirs, executors, administrators, legal representatives, and assigns as well as the Participant.
FITNESS TO PARTICIPATE
5. The Participant, or the Participant's parent or legal guardian if the Participant is under 18 years of age, acknowledges to the Activity Provider that the Participant does not have any physical limitations, medical ailments, or physical or mental disabilities that would limit or prevent the Participant from participating in the Activity. If required, the Participant or the Participant's legal guardian will obtain a medical examination and clearance.
FULL AND FINAL SETTLEMENT
6. The Participant, or the Participant's parent or legal guardian if the Participant is under 18 years of age, acknowledges and agrees with the Activity Provider that:
(1) the Activity Provider has given the Participant, or the Participant's parent or legal guardian if the Participant is under 18 years of age, sufficient time to carefully read this Waiver,
(2) the Participant, or the Participant's parent or legal guardian if the Participant is under 18 years of age, has been given the opportunity and has been encouraged to seek independent legal advice prior to signing this Waiver,
(3) the Participant, or the Participant's parent or legal guardian if the Participant is under 18 years of age, fully understands the risks and claims that the Participant is waiving to participate in the Activity,
(4) the Participant, or the Participant's parent or legal guardian if the Participant is under 18 years of age, is freely and voluntarily executing this Waiver, and
(5) the Participant, or the Participant's parent or legal guardian if the Participant is under 18 years of age, is forever prevented from suing or otherwise claiming against the Activity Provider for any property loss or personal injury that the Participant may sustain while participating in or preparing for the Activity.
GOVERNING LAW
7. This Waiver will be governed by and construed in accordance with the laws of the State of Utah.
Finally, I, the Participant, and the Participant's parent or legal guardian if the Participant is under 18 years of age, understand and acknowledge that by giving my signature or electronic signature I have agreed to the terms of this Waiver. Entering my name into the Activity registration form under "Full Signature" constitutes my electronic signature of this Waiver.
