HERRIMAN CITY EVENTS LIABILITY WAIVER
The undersigned wishes to participate, by their own free will, in the Herriman City Yeti Run and recognizes and acknowledges that there are certain inherent hazards and risks associated with this activity of Herriman City (hereinafter referred to as the “City”).
I acknowledge that participating in the Yeti Run, a run/walk is a potentially hazardous activity/activities, which could result in property damage, injury, permanent disability, or death. The undersigned, hereby knowingly and voluntarily assumes full responsibility for such risks and hazards and agrees to be bound by all terms and conditions of the City’s rules and procedures, along with any rules or instruction given to participant(s) from someone supervising the Yeti Run.
The risks of injury and death are increased if not in good health or properly prepared. I also know that there are inherent risks in participating in physical activities, including, but not limited to, muscular skeletal injuries, dislocations, broken bones, cuts, exhaustion, dehydration, cardiovascular events, falls, contact with other participants, weather conditions, and close proximity to other parties. A participant could be kicked, run over, pushed down, stepped on, or collide with another object. This is not an all-inclusive list of what could happen to a participant in the Yeti Run.
As a condition of my participation in Yeti Run, I represent that I am in good health and have properly prepared myself. I also represent that I have read the above section and understand the risks involved in my participation. I represent that I will follow the directions of any city official, city employee, or any employee in charge. I acknowledge that my participation in activities may be terminated if I engage in any illegal, dangerous, or disruptive behavior or if I fail to listen to any direction. I voluntarily assume all risks associated with my participation in this event.
In consideration of my participation in the Yeti Run, I waive and release Herriman City, and their respective officials, officers, employees, volunteers, and agents from any claim, liability, or cause of action, including those of negligence, arising from my participation. I agree that this form is binding upon me, my heirs, next of kin, legal representatives, successors, and assigns. The undersigned also agrees to release, defend, indemnify, and hold harmless the City, it’s officers, agents, employees and volunteers from and against any and all loss, judgements, damages and expenses incurred by reason of any claim or liability.
I hereby consent to allow my picture or picture of my child and or likeness to appear in any official documentary, promotional, exclusive television, radio, or film coverage of the Parks & Recreation Department in any manner incidental to my participation in the activity of the Herriman City Parks & Recreation Department without compensation to me or my child.
I have read and fully understand the Liability Waiver Agreement and recognize that it is a legally binding agreement. If I have any doubts concerning any of the above content, I will not participate.
I ACKNOWLEDGE THAT I HAVE READ THE FOREGOING, and that I am aware of the legal consequences of this Agreement. By signing below, I express my understanding and intent to enter into this Agreement knowingly, willingly, and voluntarily.
